Not Posting Results on IReV Can’t Nullify Election – Supreme Court

The Supreme Court has dismissed the argument of the People’s Democratic Party (PDP) that the 2023 Presidential election won by Bola Tinubu should be nullified because of the failure the Independent National Electoral Commission (INEC) to upload results on IReV portal, real-time.

The apex court in the ruling on Thursday maintained that, “from the provisions of the Electoral Act, a petition must not only show non – compliance, it must also show how it affected the election results.
“The IReV portal is not a collation system even though part of the election process. Failure of IReV does not mean collation will have to stop. Collation is done manually,” Justice John Okoro ruled.
The apex court also faulted appellants for abandoning their duties to prove non-compliance and how it affected the results but instead focused on the issue of failure of IReV.
